Service Description
Annex 1 to the General Terms and Conditions of ProntoWeb · Part of the contract (Terms § 3)
§ 1 Subject matter
This annex describes what we provide in the “Website subscription” and what we do not.
§ 2 Before the contract
- In the WhatsApp conversation, our AI assistant asks about your business, your services, your contact details and the information for your legal notice (Impressum). You can send texts, photos, logos and documents, as well as voice messages and links.
- From this, exactly one draft is created. You receive it as a link. A band at the edge shows that it is a draft.
- Until payment, we change content at your request. If the conversation reaches our cost limit, it continues after the order. We do not change the design before payment. We note requests concerning the design and implement them after the website goes live. They then count as changes under § 3 (3).
§ 3 In the subscription
-
Your website consists of:
- a home page and the further pages shown in your draft,
- a legal notice and a privacy policy (§ 4),
- a menu with readable names,
- one-click contact by phone, email or WhatsApp, a link to your Instagram profile and a button “Online buchen” (book online) that leads to your booking or reservation service, insofar as you give us these details,
- an encrypted connection (HTTPS),
- fonts, images and videos from our own server, without cookies, forms or embedded third-party content,
- in the footer of every page, the notice “Made with ♥ by ProntoWeb” with a link to ProntoWeb and the link “Inhalt melden” (report content) (Annex 5 § 2). The notice is part of the subscription. Whether you can have it removed for an additional charge is set out in the price list (Annex 2 § 9).
The address has the form name.prontoweb.io. Live, your website looks exactly like the draft, only without the band.
- Changes are included. You tell us via WhatsApp what you would like changed. This can be content: texts, images, opening hours, contact details, lists (for example menu, prices, services) and posts. It can also be the design: colours, fonts, layout or the look of images, as well as a new section or a new page, for example for content for which your website does not yet have space. You do not have to distinguish whether a request concerns the content or the design, and we do not count redesigns.
- Fair use limit. In each calendar month we apply changes until they reach computing costs of 5 US dollars. These are the costs of the AI models that carry out your changes; the conversation with you does not count towards this. A change to the content usually costs a few cents, a change to the design usually around 15 cents. Once the limit is reached, we tell you in the conversation. We then apply further changes from the 1st of the following month; please send us your requests for this again. Whatever is not used in a month expires at the end of the month. We do not offer the purchase of additional changes. We correct an error on your website even if the limit has been reached (Terms § 7 (2)); this does not count towards the limit. In that case, simply tell us about it in the conversation. Your rights in the event of defects remain unaffected (Terms § 11).
-
Images.
- Stock photos: We use licensed photos from Pixabay (licence: pixabay.com/service/license-summary). We upload them to our own server so that your website does not load any third-party content. We never use a stock photo as your logo. We do not choose motifs with brands. The image credits are given in the legal notice.
- AI images (once we offer them, price in Annex 2 § 6): They are created only with your yes. How we label them is set out in Annex 6 § 3.
- Videos: A video that you send us appears on your website as a silent loop, at most the first 20 seconds. To do this, we convert it on our own server and remove sound, location data and other metadata. It has a still image and a button to pause it. Anyone who has set reduced motion on their device sees the still image. If a video is longer or cannot be converted, we tell you in the conversation.
- Search engines and AI. Your website is public, and search engines and AI assistants are meant to find it. They may read it and reproduce your information, including prices and opening hours. We do not promise any particular ranking. On your behalf, we object in machine-readable form to crawlers that collect pages for training AI models (reservation of use under § 44b (3) UrhG). Google controls training and answers in Gemini through the same switch. We leave it open so that your website remains visible in Gemini. We cannot guarantee that every operator respects the objection.
§ 4 Legal notice and privacy policy of your website
-
Our system generates the legal notice from your information:
- always: name or company name, legal form, address and email,
- where applicable to you: register court, register number, authorised representatives and VAT ID.
Without this information your website does not go online (Terms § 7 (1)).
-
Not included automatically is information that only certain professions need:
- supervisory authority for activities requiring a licence,
- chamber, statutory professional title and professional rules (§ 5 (1) nos. 3 and 5 DDG),
- professional liability insurance (§ 2 DL-InfoV).
If you practise such a profession, please give us this information in the conversation.
- The privacy policy describes what your website does with visitors’ data: delivery via our host, server logs, no cookies, no statistics about individual visitors, fonts, images and videos from our own server, what happens when a contact button is clicked and, once we offer it, the counting under § 9.
- If a new legal situation requires a change, we apply it to your website.
- The legal notice and privacy policy are created from a fixed template and your information. This is not legal advice in an individual case. For errors in our template we are liable under Terms § 11 (1) to (6). We do not check obligations specific to your sector, for example regarding price information, health advertising or allergens.
§ 5 Availability
- Your website is available around the clock. We remedy disruptions in our area as quickly as we can. We do not promise a percentage of availability.
- This does not apply while we block content or your website under Terms § 7 (4) or have taken your website offline because of an outstanding payment (Terms § 4 (6)).
- For the WhatsApp conversation we promise no availability and no response time. WhatsApp is operated by Meta, not by us.
- Your rights in the event of defects remain unaffected (Terms § 11).
§ 6 Updates
- We keep your website technically up to date and secure during the term. This includes security updates, valid certificates for HTTPS and correct display in current browsers.
- We install updates ourselves; you do not have to do anything. We inform you about updates that you need to know about in order to use your website as agreed.
- Updates change neither the content nor the design of your website. For other changes, Terms § 3 (6) applies.
- If we find a better design for websites like yours, we offer it to you if you have agreed to such notices (Terms § 3 (9)). You see it beforehand under your link and decide with yes or no. Such an offer does not count towards the limit under § 3 (3).
§ 7 What is not included
- a domain of your own (unless booked, Terms § 16) and email mailboxes,
- forms, shop, booking or payment functions, newsletters and login areas. The button “Online buchen” (book online) is only a link to your service (§ 3 (1)),
- visitor statistics beyond the figures under § 9, advertising and embedded third-party content such as maps, videos or social media feeds,
- videos with sound for watching. A video that you send us plays without sound (§ 3 (4)),
- a ranking in search engines, a particular number of visitors and search engine optimisation beyond a clean basic structure,
- legal advice and the checking of obligations specific to your sector (§ 4 (5)),
- an assurance of accessibility under the Accessibility Strengthening Act (Barrierefreiheitsstärkungsgesetz). We measure contrast and readability on every page.
§ 8 Your data as a ZIP file
-
You can request your data as a ZIP file at any time, during the contract and up to 30 days after it ends. If you request it via WhatsApp or email, we send it to you. The ZIP file contains:
- what you sent us: your texts and the transcripts of your voice messages as a text file, photos, logos and documents in the format in which you sent them,
- your videos in the version that ran on your website (MP4, without sound),
- the texts that we wrote for you, that is, the texts of your website,
- your business details (name, address, opening hours, services, contact) as a file that other programs can read (JSON),
- the AI images of your website with their labelling, once we offer AI images.
-
The ZIP file does not contain:
- the recordings of your voice messages and your videos in the original. In the case of a switch, we send them to you in addition on request, as far as we still have them (Terms § 6 (6) no. 2),
- design, templates, program code and framework of your website (Terms § 8 (3)),
- stock photos. You can download them from the provider yourself under the provider’s licence (Terms § 8 (5)),
- server logs (Annex 4 § 10).
- After the end of the contract, we do not continue to operate your website. If you want to switch, Terms § 6 (6) applies: your website then remains online during the transition period.
- After the 30 days, we delete the content of your website, unless we are required to keep it (Terms § 12 (1)). In the case of a switch, we also delete the conversation (Terms § 6 (6) no. 5).
§ 9 Figures for your website (once we offer this)
- Your website counts how often it is visited and how often visitors tap a contact button, for example call, WhatsApp, email, Instagram or directions.
- We count without cookies, without storing anything on or reading anything from visitors’ devices, and without an identifier. Only the total per day is stored. We do not store IP addresses for this.
- We send you your figures if you have agreed to notices (Terms § 3 (9)). Aggregated across many websites, we use them under Terms § 8 (7).
- Before we switch on the counting on your website, we tell you (Terms § 3 (6)). The privacy policy of your website then describes it.
