Content Policy and Notice Procedure (DSA)
Annex 5 to the General Terms and Conditions of ProntoWeb · Part of the contract (Terms §§ 7, 13)
§ 1 Prohibited content
-
Websites that we operate must not contain any illegal content. Examples:
- content that infringes copyright, trademark rights or personality rights, including the right to one’s own image,
- insults and untrue statements of fact about others,
- misleading or otherwise unfair advertising,
- content that is a criminal offence, for example incitement to hatred or symbols of unconstitutional organisations.
-
We do not design websites for the following areas. The list is exhaustive.
- Erotica: sexual services, erotic offerings and pornography.
- Gambling: gambling and betting, including their brokerage.
- Weapons: sale and brokerage of weapons and ammunition, including gun shops and hunting supply shops. Sport shooting clubs are permitted.
- Drugs: narcotics, cannabis, CBD and hemp products, as well as cannabis cultivation associations.
- Extremism: extremist, discriminatory or violence-glorifying content.
- Promises of healing: statements that promise the cure or alleviation of diseases or the certain success of a treatment. Alternative practitioners (Heilpraktiker), massage and other health professions are permitted, with factual information about their services.
- Finance: only the brokerage of investments, loans and crypto-assets. Insurance brokers and real estate agents are expressly permitted.
- We do not check content in advance for lawfulness. Our automated checks concern the display (overflow, contrast) and whether information on the page comes from you. They do not check whether content is lawful.
§ 2 Notice procedure (Art. 16 DSA)
-
Anyone can report to us content that they consider illegal. There are two ways to do this:
- the link “Inhalt melden” (report content) at the bottom of every website that we operate. It opens an email to prontoweb@tiro-agent.com in which the address of the page is already filled in.
- an email to prontoweb@tiro-agent.com.
-
A notice should contain:
- an explanation of why the content is illegal,
- the exact address (URL) of the content,
- your name and your email address,
- a statement that you believe in good faith that the information is accurate and complete.
Name and email address are not required if the matter concerns the sexual abuse of children.
- We confirm receipt without undue delay. We inform you of our decision, together with the means of redress available to you.
§ 3 Review and decision (Art. 17 DSA)
- Every notice is reviewed by a human, in a timely, diligent and objective manner. There are no automated decisions on notices.
- Possible measures are: blocking an individual piece of content, taking the website offline (Terms § 7 (4)) or, in serious cases, terminating the contract (Terms § 6 (4)).
-
We give you as a customer reasons for every block and every other measure in text form, at the latest when it takes effect (Art. 17 DSA). The statement of reasons sets out:
- the type of measure: what we have blocked, to what extent and for how long,
- the facts and circumstances on which we rely, including whether we acted on a notice or on our own initiative,
- whether we used automated means to detect the content or to decide on it,
- the provision concerned: for illegal content, the law; otherwise, the rule of this policy or of the terms,
- your means of redress: the appeal under § 4 and recourse to the courts.
§ 4 Appeal
- You may lodge an appeal against a decision under § 3, as a customer or as the person who submitted the notice, within six months, by email or via WhatsApp.
- The appeal is reviewed by a human, where possible not the same person who made the decision. If the appeal is justified, we reverse the measure without undue delay. If the measure is upheld, we also give reasons for this under § 3 (3).
- Recourse to the courts remains open to you.
§ 5 Criminal offences
If we become aware of content that indicates a criminal offence involving a threat to the life or safety of persons, we inform the law enforcement authorities (Art. 18 DSA).
§ 6 Points of contact (Art. 11, 12 DSA)
The single point of contact for authorities, the EU Commission, the European Board for Digital Services and for users is prontoweb@tiro-agent.com. We can be reached in German and in English. Replies are written by a human.
